Terms & Conditions

  • OYBike agrees to let and the Hirer agrees to take on rental the bike subject to the terms and conditions set out herein. OYBike and the Hirer are the only parties to this Agreement, notwithstanding that a reservation for the bike may have been arranged by a third party or that a third party may pay for all or part of the hire. The Hirer is the sole lessee and is solely responsible for compliance with all terms and conditions contained herein. 
     
  • The Hirer agrees to return the bike to OYBike in the same condition received, ordinary wear and tear excepted. The Hirer agrees not to use a bike for onward hire or reward, nor use it in violation of any law, ordinance or regulation, nor remove it (without prior written consent of OYBike) from England, Scotland or Wales.
     
  • The Hirer hereby warrants and undertakes to OYBike that he will not operate the bike or permit the bike to be operated whilst unfit through drink or drugs or with blood alcohol concentration above the limit prescribed for the time being by road traffic legislation.
     
  • The Hirer hereby warrants and undertakes to the OYBike that he will further protect the interests of the bike by ensuring the bike is always locked when unattended.
    If the Hirer commits any breach of these terms and conditions OYBike may treat the agreement as terminated and may seize, without legal process, or notice to the Hirer, the bike at any time or place and the Hirer waives all claims for damages connected with such seizure.
     
  • The Hirer expressly agrees to pay OYBike on demand all fines and court costs including administrative fees for parking, bus lane, traffic or other legal violations assessed against the bike, the Hirer or OYBike during the hire. 
     
  • The Hirer expressly agrees to pay OYBike on demand a reasonable administrative handling fee for processing any fine or legal violation against the bike, the Hirer or OYBike during the hire except where caused by OYBike’s default.
     
  • The Hirer expressly agrees to pay OYBike on demand Value Added Tax and all other taxes (if any) payable on the aforesaid items.
     
  • The Hirer expressly agrees to pay OYBike on demand OYBike’s costs, including reasonable legal fees where permitted by law, incurred collecting payments due from the Hirer hereunder.
     
  • The Hirer expressly agrees to pay OYBike on demand the fair market value of repairing damage howsoever caused to the actual bike supplied.
     
  • The Hirer agrees to defend, indemnify and hold OYBike harmless from all losses, liabilities, damages, injuries, claims, demands, costs and expenses (except where caused by OYBike’s negligence or default) incurred by OYBike in any manner from this rental transaction.
     
  • Use of the OYBike system is open to all persons over the age of 12. Persons over the age of 12 but under the age of 18 must have the written permission of a parent or guardian to register to use the system and the written permission of the nominated payer to make payment for the hire of the bike (sent to OYBike Systems Ltd at No.1 Olympic Way , Wembley , Middlesex, HA9 0NP).
     
  • Persons over the age of 12 but under the age of 18 must also provide evidence of proficiency to ride on the road. (contact www.cycletraining.co.uk for information on cycling proficiency classes).
     
  • When you accept the application form you are declaring that you are physically fit enough to ride a bicycle and also that you are reasonably competent to ride on the road.
     
  • On payment the appropriate premium OYBike will cover the cost of any damage to the bike or cost of replacement due to theft (but no damage to the Hirer or any third party). The cover is valid from the time of payment to OYBike for a period of one year and is a legally binding contract between the applicant and the OYBike Systems Ltd. The cover becomes void with immediate affect if the hirer is riding under the influence of alcohol, drugs, medication or any other medium that affects judgment or perception in any way.
     
  • Once the hire has commenced, the Hirer has full responsibility over the bicycle. Should the Hirer not have taken out appropriate insurance they will be liable for all costs in the event of damage to the bike, themselves or third parties or theft whilst the bike is in their care.
     
  • It is the Hirer’s responsibility to ensure that the bicycle is in proper working order BEFORE the hire takes place; this includes brakes, lights, steering, tyres and drive shaft including pedals.
    Brakes - To test the brakes squeeze either the left or right brake lever towards the handlebar and try to push the bike along the ground. If both wheels roll then there is a problem with the brakes. If one wheel will not turn then repeat the above with the opposite brake lever. Both levers should cause one of the wheels to stop moving when rolled. If the brakes feel in any way loose.
    Both the front and the back lights should come on when the front wheel is spinning.
    Lights - To test the lights once the bike is checked out please walk and push the bike in your hands. After 3 meters the front and rear lights should be illuminated. If they do not illuminate please return the bike to the Rental Station and inform OYBike (0845 226 5751).
    Steering – Stand next to the bicycle you would like to hire and holding the handlebars press your hands down and turn the handlebars to the left and to the right. The front wheel should follow the handlebars with no delay. The front wheel should also line up directly with the front handlebars.
    Tyres – Both tyres should be inflated to +60psi but will operate safely from +35psi. To test the tyres squeeze the sides of the tyre with your thumb and forefinger. They tyre should not depress inwards by more than 2mm on each side. If it does go in further than 2mm then the bike should not be ridden.
    Drive Shaft – To test the driver shaft and the pedals check the bike out and find a safe area that is away from traffic, pedestrians and other dangers. Start cycling and make sure that the drive shaft operates smoothly with no unusual sounds or movements. Also check that the pedals are securely attached to the crank.
    If there are any problems with the bicycle then this must be reported immediately to OYBike via telephone (0845 226 5751) and another bike may be allocated. 
     
  • Any wilful or negligent act of destruction of OYBike property will result in prosecution to the fullest extent of the law and OYBike will seek the recovery of all costs and administration charges from the defendant.
     
  • The OYBike cycles are for the exclusive use of the Hirer only. All other situations will invalidate the hire conditions and any insurance cover.
     
  • The front basket is intended to carry light goods only. DO NOT fill with heavy items(over 5kg) as this may affect your balance, steering control as well as safety and comfort.
     
  • DO NOT fill past the rim of the basket. Fill evenly with no long or sharp edges sticking out of or through the basket as these may become dangerous to other pedestrians and to the rider.
     
  • If an accident should occur due to the carriage of an over-weight or awkward load then the hirer is liable for all costs and the insurance becomes void.
     
  • If any of the working parts should become defective whilst riding an OYBike, the rider MUST STOP and call OYBike customer services (0845 226 5751). They may issue another bike to you at the nearest OYBike rental station or arrange to pick up the faulty cycle.
     
  • DO NOT pull or push anything with the bicycle as this may lead to steering defects, mal-align the frame or cause undue ‘wear and tear’ to the tyres.
     
  • DO NOT use the OYBike for racing, mountain bike riding, stunt or trick riding or for any other purpose other than riding to and from a destination.
     
  • In the event of a puncture or burst tyre, the hirer should STOP riding and call OYBike customer services (0845 226 5751).
     
  • OYBike reserves the right to cancel any contract/hire agreement at any time with a customer without prior arrangement or written warning if the customer is in default hereunder.
     
  • NOTHING IN THESE TERMS AND CONDITIONS EXCLUDES OR LIMITS THE LIABILTY OF OYBIKE FOR DEATH OR PERSONAL INJURY CAUSED BY OYBIKE’S NEGLIGENCE. OTHERWISE OYBIKE’S TOTAL LIABILTIY IN CONTRACT, TORT, INCLUDING NEGLIGENCE AND BREACH OF STATUTORY DUTY, MISREPRESENTATION, RESTITUTION OR OTHERWISE , ARISING IN CONNECTION WITH THE HIRE SHALL BE LIMITED TO THE AMOUNT IT RECEIVES HEREUNDER. OYBIKE SHALL NOT BE LIABLE TO THE HIRER FOR ANY PURE ECONOMIC LOSS, LOSS OF PROFIT OR LOSSES OF BUSINESS IN EACH CAES WHETHER DIRECT, INDIRECT OR CONSEQUENTIAL OR ANY CLAIMS FOR CONSEQUENTIAL COMPENSTION WHATSOEVER AND HOWSOEVER CAUSED WHICH ARISES UNDER THE HIRE.
